Recently, a Bay Area nonprofit organization retained Emergent Legal to conduct an internal investigation in response to allegations of racial discrimination. We conducted interviews of the employees who had witnessed the alleged events, and prepared a report for the organization's Board of Directors that discussed the merits of the potential claims and recommended internal changes to discourage future complaints. We also communicated with the potential plaintiff's counsel to describe our findings and explain why the allegations were factually baseless and legally infirm. The organization has begun to adopt our recommendations, and the potential plaintiff has not filed suit.
