Emergent Legal has settled a contentious, long-running dispute between a local fine artist and a Bay Area gallery through voluntary mediation. In 2012, the artist -- an internationally-collected photographer -- loaned a number of works to the gallery as part of a group show. Several items were damaged, and in mid-2013 the parties attempted to mediate. A resolution was reached under which the gallery would take responsibility for filing an insurance claim, but the agreement fell apart over the handling of the insurance claim and its outcome. In December, the artist retained us. We reengaged the gallery, obtained key information about the insurance claim, and brought the parties back to the mediation table. Yesterday, the parties agreed to a new settlement, with the gallery paying the artist three times the amount offered by the insurer.
