These Terms of Use (“Terms”) govern your access to and use of emergent.law (the “Site”), operated by Emergent (“Emergent,” “the Firm,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. No Attorney-Client Relationship

Use of the Site, including submission of information through our Consultation form or any other contact method, does not create an attorney-client relationship between you and Emergent or any of its attorneys. An attorney-client relationship is formed only when both you and Emergent have signed a written engagement agreement.

Until an engagement agreement is signed:

  • Do not send confidential or privileged information through the Site.
  • Information you submit may not be treated as confidential or privileged.
  • Emergent is under no obligation to act on any information you provide, and doing so does not obligate the Firm to represent you.
  • If Emergent does not agree to represent you, you should promptly seek other counsel, particularly with respect to any applicable deadlines or statutes of limitation.

2. No Legal Advice

The content on the Site — including practice area descriptions, attorney biographies, and any articles or commentary — is provided for general informational purposes only and does not constitute legal advice. Legal outcomes depend on the specific facts of each matter, and prior results described on the Site do not guarantee or predict similar outcomes in future matters. You should not act, or refrain from acting, based on information from the Site without seeking advice from a licensed attorney regarding your specific situation.

3. Use of the Site

You agree to use the Site only for lawful purposes. You agree not to:

  • Use the Site in any way that violates applicable law or regulation

6. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, Emergent and its attorneys, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your access to or use of (or inability to access or use) the Site, even if advised of the possibility of such damages.

8. Jurisdictional Limitations

Emergent’s attorneys are licensed to practice in specific jurisdictions. Nothing on the Site should be construed as an offer to provide legal services in a jurisdiction where Emergent or its attorneys are not authorized to practice, or as solicitation of business from anyone in a jurisdiction where such solicitation would violate applicable law or ethical rules.

9. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.

We may revise these Terms at any time by updating this page. The “Effective Date” above reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
